Partner Visa Onshore Subclass 309/100

This partner visa is for offshore applicants, the main applicant will have to wait until the visa is granted to be able to visit Australia lawfully, you can apply for visitor visa while you are waiting. This visa consists of 2 stages. Stage 1 subclass 309: this is a temporary visa and has to be lodged outside of Australia. Your sponsor must be either an Australian citizen or permanent resident, you can either be married to the sponsor or in a de facto relationship to be eligible for this visa. You will be able to study and work with no limitation when you are granted a subclass 309. Stage 2 subclass 100: this is a permanent resident visa, all that you need to continue proving your commitment with your partner in order to be successful with this application. Sponsorship application is required before the sponsor is able to sponsor the main applicant to be eligible as the first step of subclass 309.

Additional Proof of Your Relationship

You can submit the same proof as from your 820 application but your chance of success is low, you need to show that you have been staying together while holding or waiting for subclass 820 so that the department see your commitment of staying together.

Changes to Your Relationship
